This guide is general information, not legal advice. Laws differ by province, territory and state — have a lawyer licensed where you operate review agreements with significant money or risk attached.

Are you signing your copy or collecting another signature?

If you received a contract, your first task is to review the terms and confirm you are the correct signer. If you are requesting somebody else’s signature, preparation and completion checks are different. This guide focuses on the signer’s decisions, not a list of buttons in a particular platform.

An electronic signature can be a symbol or process adopted with intent to sign. A drawn name, typed name or click may form part of that process, but its appearance alone does not prove who signed or what they agreed to. A cryptographic digital signature is a particular technical method; not every ordinary contract requires one.

Do not paste someone else’s signature image into a document. If you sign on behalf of a business, confirm your authority and identify that capacity. A tool’s ability to add a mark does not establish permission to bind another person.

Review the complete final version

Read every page and attachment. Confirm the parties, price, currency, deadlines, cancellation terms and any obligations that continue after the agreement ends. Check that referenced schedules are actually attached and that there are no blanks or unresolved comments.

Compare the final PDF with the deal you negotiated. If a term is wrong, ask for a corrected version before signing. Avoid assuming an earlier email automatically overrides contradictory wording in the document; the relationship between documents can itself become disputed.

Check your signature block and capacity. A director signing for a company should not accidentally sign as an individual guarantor. If you do not understand a guarantee, waiver or major liability term, obtain local advice rather than treating signing as a clerical task.

Check whether electronic execution is appropriate

Identify the jurisdiction and document type. Many ordinary business agreements can use electronic signatures, but some documents have excluded or specially regulated execution, witnessing, notarization, filing or delivery requirements. Those are separate questions from whether a signature can be electronic.

In the US, E-SIGN generally prevents denial solely because of electronic form within its scope. State law also matters. In Canada, provincial and territorial rules are central to many private transactions, while federal requirements have their own framework. BC’s Electronic Transactions Act is one provincial example, not a universal Canadian rulebook.

For wills, powers of attorney, land-related documents, court records or regulated notices, check the specific governing rules before choosing a signing process. An exclusion from one statute does not necessarily mean electronic execution is forbidden under every other law.

Apply your signature deliberately

Use the agreed signing method and complete all fields required for your role. Check the displayed name, date and any initials. Read a confirmation statement before adopting it; clicking a button should reflect your intention to accept the identified record.

If you upload a PDF, review its layout after adding fields. Make sure your signature does not obscure a clause, amount or another person’s field. If the file is locked, ask for an appropriate version rather than removing protections from somebody else’s completed record.

Illustrative check: Jordan signs a service agreement for a corporation. Jordan confirms authority, checks that the signature block names the corporation, verifies the attached scope and signs the final version. The important steps are authority, final terms and deliberate assent—not whether the mark looks handwritten.

Confirm completion and retain useful evidence

Keep the completed document and relevant messages showing what was agreed. When multiple parties must sign, check that all required signatures relate to the same version. A document with only your signature may not represent a completed multi-party agreement.

Depending on the process, useful records can include timestamps, delivery communications, identity checks and evidence tying the signing action to the document. Evaluate what your chosen method actually supplies; do not assume every tool produces the same audit evidence.

Store the record so it remains accurate, accessible and reproducible. Keep attachments with it. If a correction is needed after completion, record an amendment or replacement process accepted by the parties; do not quietly change the signed PDF and present it as the original.

Resolve common signing problems before accepting

  • Wrong name or business: ask for a corrected signature block and confirm capacity.
  • Missing attachment: request the complete version before signing.
  • Unexpected changes: compare versions and settle the disputed terms.
  • Unreadable or inaccessible file: obtain a format you can review and retain.
  • Unfamiliar sender: verify the request through a trusted channel before providing personal information.

A rushed electronic signature can create the same problems as a rushed paper signature. Electronic form is not a substitute for agreement, authority, capacity or lawful terms. For sending rather than signing, use a sender-side checklist and verify completion separately.

Frequently asked questions

A typed name can be part of an electronic signature process when adopted with intent to sign, but its appearance alone does not establish identity, assent, authority or compliance with applicable formalities.

No. Electronic signature is the broader concept; a cryptographic digital signature is a particular technical method.

Do not silently alter the completed record. Use an agreed amendment or replacement process and retain the original and related communications.
